Delta-8, made from hemp, is milder than the THC found in marijuana. It was being sold in Texas openly until October, when the Department of State Health Services added it to a list of illicit drugs. The judge ruled that the state failed to notify retailers adequately. Judge Jan Soifer , Texas' 126th district granted the injunction in Travis County. Hometown Hero, a retailer of delta-8, filed the suit along with a Houston hemp processing facility.     Retailers and customers considered Delta-8 legal, and they claim it falls under the Farm Bill of 2018. This law legalized hemp and derivatives as long as their THC content is below 0.3%. The state will likely appeal the decision.     The most popular cannabinoid on the market right now is Delta-8 THC.
